Your Website. Your Data. Your Content. Even If You Leave.
Ask most agencies who owns your website, your ad accounts, and your content if you part ways, and the answer gets vague. Ours is written into our contract and published on this page. TMC Marketing does not use your own property as leverage to keep you as a client. The work should be why you stay.

What TMC Marketing clients own, in one place
- TMC Marketing clients own their domain, website, CRM data, finished content, ad accounts, Google Business Profile, social profiles, and email lists.
- Leaving requires thirty days' written notice, and every client receives one complete export of their site and data at no charge.
- On exit TMC Marketing removes itself from every client account and gives fourteen days' notice before anything is deactivated.
- Websites are built on standard WordPress, so any developer can take them over.
- TMC Marketing keeps only raw production files, its internal build system, and third-party software licenses.
- This ownership standard is part of The TMC Marketing Department and is written into the TMC Marketing Terms and Conditions.
Taken Directly From Our Contract
TMC Marketing Terms and Conditions of Service, Section 6.3“TMC Marketing does not hold a Client’s website, content, or data as leverage. The Client’s property is the Client’s, and TMC Marketing will not withhold, disable, delete, or ransom it in a dispute over fees or terms.”
That sentence exists because we have onboarded clients whose previous providers locked them out of their own websites, held domains they never registered, or refused data exports until disputed invoices were paid. If money is ever owed, we pursue it the normal way. Your property stays yours the entire time.
What You Own, Item by Item
Everything below is your property under our Terms and Conditions. None of it transfers to TMC Marketing at any point in the engagement.
Your Domain
Registered in your name, in your registrar account. We never register a client domain under our own account.
Your Website
Pages, content, media library, database, and the installed instance of the theme built for you.
Your CRM & Data
Contacts, conversations, form submissions, calendar records, and pipeline data. Standard export included on exit.
Your Finished Content
Every finished video, graphic, article, and photo we deliver. Use, publish, and repost it forever, with anyone.
Your Ad Accounts
Google and Meta accounts in your name. Ad spend goes from you directly to the platforms, never marked up through us.
Your Business Profile
Your Google Business Profile and its reviews, photos, and history stay under your ownership with us as a manager.
Your Social Profiles
Facebook, Instagram, LinkedIn, YouTube, and every other profile stays registered to you. We work as added users.
Your Email Lists
Subscribers, segments, and consent records are your data, included in the standard export when you go.
Our Stack, Named. No Mystery Software.
Some agencies keep their tools secret because the tools are the lock-in. Ours are chosen for the opposite reason: every platform we build on either belongs to you or exports cleanly.
WordPress
We build client websites on WordPress, the most widely used content management system in the world, with a custom hand-coded theme and structured content fields, so text, images, and posts are editable without touching code.
GoHighLevel (LeadConnector)
Contacts, forms, calendars, pipelines, and marketing automation run on GoHighLevel, the same platform disclosed in our privacy policy. It is where your leads and conversations live while we work together.
Google Analytics & Search Console
Analytics and Search Console are set up as properties in your Google account, with TMC Marketing added as a user. Your traffic history and search data accumulate under your ownership from day one.
Hosting & Subscriptions
Some subscriptions, like website hosting, run through TMC Marketing’s commercial accounts while we work together. Those accounts end on your final date because they are ours, not yours. What protects you is the export: one complete copy of your site files, database, media, and CRM data, free on request, plus good-faith help re-establishing services in your own name.
What Stays Ours, and Why
A transparency page that only lists the good parts is a sales page. Three things remain TMC Marketing property, and each has a specific reason.
Raw & Source Files
Camera originals, unedited footage, project timelines, and layered design files are our working material.
The restriction is narrow by design: it stops another provider from building new work out of our production files. Every finished piece we deliver is yours without limitation, and a future agency can use your finished content freely.
Our Build System
The block libraries, frameworks, and automation blueprints we build every client from are our tools, refined across dozens of projects.
Your site’s installed instance is licensed to you permanently. Edit it, extend it, hire anyone to maintain it. The only thing you cannot do is redeploy our master system to build other projects.
Third-Party Licenses
Stock footage, music, imagery, and software we license are licensed to us, because that is how those licenses work.
Your finished deliverables are cleared for your use. If you ever need ongoing rights to a licensed element, like re-editing around a music track, you would obtain your own license, and we will tell you exactly which elements those are.
The Exit, Step by Step
No agency should make you guess what leaving looks like. This is our documented offboarding standard, straight from the contract.
Thirty days written notice
Email is fine. Work and reporting continue at full quality through the notice period, because the last month is still paid work.
One complete export, free
On request any time up to 30 days after your final date: site files, database, media library, and a standard export of your CRM records. No fee, no conditions.
We remove ourselves from your accounts
Within 10 business days of your written request, our access to your domain, ad accounts, profiles, and analytics is removed and confirmed to you in writing.
Fourteen days notice before anything is deactivated
Any environment holding your data gets at least 14 days written warning before deactivation, so nothing disappears while you migrate.
Your finished content is yours forever
Everything already delivered or published stays with you. Keep using it, reposting it, and building on it with whoever comes next.

See Our Operating StandardsStraight Answers on Who Owns What
Who owns my website if I stop working with TMC Marketing?
You do. Your website, including its pages, content, media library, database, and the installed theme instance, is your property under our Terms and Conditions, along with your CRM and marketing data. On written request up to 30 days after your final date, TMC Marketing provides one complete export of all of it at no charge.
Can a marketing agency hold my website hostage?
It happens more than it should, usually through agency-registered domains, agency-owned hosting, or proprietary page builders that nothing can be exported from. TMC Marketing’s contract states the opposite: we will not withhold, disable, delete, or ransom a client’s website, content, or data in a dispute over fees or terms. Before signing with any agency, ask who registers the domain, whose name is on the hosting, and exactly what an exit export includes.
Do I get the raw footage from my video shoots?
Raw footage, project files, and design source files remain TMC Marketing property, while every finished video and photo we deliver is yours to use forever. The restriction exists for one narrow reason: preventing our production work from being handed to another provider to build new content from. During an engagement we can grant raw file access for internal use, and extensions after exit can be arranged in writing.
Who owns my ad accounts and the data in them?
You do. Ad accounts are registered in your name, and your ad spend is paid by you directly to Google or Meta rather than passing through us. Campaign history, audiences, and conversion data all stay with you. When an engagement ends, we remove our own access within 10 business days of your request and confirm it in writing.
What happens to hosting and software subscriptions when I leave?
Subscriptions held in TMC Marketing’s name end on your final date, because they are our commercial accounts. Before that happens you receive the free complete export of your site and data, at least 14 days written notice before any environment holding your data is deactivated, and good-faith cooperation transferring or re-establishing services in your own accounts. Migration work beyond the standard export is quoted in writing before anything is billed.
